Submitting an entry constitutes your full and unconditional agreement to and acceptance
of these Official Rules and the decisions of the Sponsor and judges, which shall be final and binding
on all matters relating to this Contest.
- Contest Period: The Venus Embrace Your Voice Contest (the “Contest”) begins at 12:00 a.m. Eastern Time (“ET”) on 8/15/2008 and ends at 11:59 p.m. ET on 9/30/2008 (the “Contest Period”).
- Eligibility: The Contest is open only to legal residents of the 50 United States, including the District of Columbia, who are 13 years of age or older as of date of entry. Employees of The Procter & Gamble Distributing LLC (the “Sponsor”), their respective parents, subsidiaries, divisions, affiliates, suppliers, distributors and advertising, promotional and judging agencies, including Don Jagoda Associates, Inc. (the “Administrator”) and their immediate family members (spouses, parents, children, and siblings and their spouses) and household members of each (whether related or not), are not eligible to participate or win. Professional singers (persons who have been paid for their singing or who are employed as singers and derived more than half of their income from such payments in a given tax year) are not eligible to participate in the Contest. Void outside the 50 United States and the District of Columbia or where prohibited by law. All federal, state and local laws and regulations apply.
- How To Enter The Contest: During the Contest Period, you may enter the Contest by visiting http://www.gillettevenus.com/summer (the “Contest Website”), completing all required registration information and following the instructions provided. You will then be provided with a toll-free phone number and passcode, which you will need to use to record your rendition of the sponsor-selected song made available at the Contest Website (the “Entry or Entry Material”). Your recording must not exceed 60 seconds. The lyrics of the song must be accurate, as provided on the Contest Website and the Entry may be disqualified at the Sponsor’s sole discretion if the lyrics are not performed accurately. Any Entry Material or portion thereof that is, in the Sponsor’s sole discretion, obscene, profane, lewd, defamatory, contains any content unsuitable for broadcast, contains any third party materials or depicts any third party in a disparaging manner, or otherwise violates or infringes (or may infringe) any copyright, trademark, logo, mark that identifies a brand or other proprietary right of any person living or deceased (including but not limited to rights of privacy or publicity or portrayal in a false light) or entity, or is otherwise objectionable, will not be considered and may disqualify the entry. All Entry Material must be suitable for broadcast or webcast as determined in the sole discretion of Sponsor. No Entry Material shall contain any content or performance that has been previously broadcast or streamed, published or televised via any format, including but not limited to radio, television, film, and/or internet audio or song. Entrants may not copy or otherwise plagiarize the Entry Material from any source and Entrants may only use the song provided on the Website for the recording of the song submitted as part of the Entry. Any recording that is not of satisfactory quality to be streamed online may be disqualified entirely from the Contest, at Sponsor’s sole discretion. Any Entry Material deemed in violation of the Official Rules, as determined by Sponsor in its sole discretion, will be disqualified and will be deemed ineligible to be judged or win any prizes. Incomplete or unintelligible Entries will be disqualified at the Sponsor’s sole discretion. If the Entry is not in keeping with Sponsor's image, or is deemed offensive, as determined by Sponsor in its sole discretion, the entry will be disqualified from the Contest. Any Entry not in compliance with the above and does not meet the Contest Website requirements will be disqualified. All Entries submitted become the property of the Sponsor and will not be acknowledged or returned. Each Entrant certifies that he/she is the person recording the song submitted as part of Entry. Limit one Entry per person/email address throughout the duration of the program. If more than one Entry is received per email address/person, only the first entry received will be eligible for the Contest. All parts of the Entry must be submitted as described herein or the entire Entry will be void. Normal Internet access and usage charges imposed by Entrants’ online service will apply. - Judging: All eligible Entries will be judged on or about 10/1/2008 to determine one Contest Grand Prize winner under the supervision of Administrator, an independent judging organization, based on the following criteria: Performance Ability/Talent 40%, Quality of Voice 40% and Enthusiasm 20%. In the event of a tie, tied entries will be rejudged based on Performance Ability/Talent. Decisions of judges are final with respect to all matters relating to the Contest. Potential Grand Prize winning Entrant will be notified by phone/mail/email on or about 10/2/2008.
- How to Enter the Sweepstakes (“Sweepstakes”): During the Contest Period, you may enter the Sweepstakes random drawing by visiting the Contest Website and completing all required registration information. All Contest entrants are automatically entered into the Sweepstakes when they complete their Contest Entry. Limit one Sweepstakes Entry per person/email address.
- Sweepstakes Random Drawing: Sixty First Prize winners will be selected in a random drawing from among all eligible entries received. Drawing will be conducted on or about 10/1/2008, by Don Jagoda Associates, Inc., an independent judging organization whose decisions are final and binding on all matters relating to the Sweepstakes. Odds of winning are dependent upon the number of eligible entries received. All prizes will be awarded and winners will be notified by mail/e-mail.
- Prizes and Approximate Retail Values (“ARV”):
- Contest Grand Prize (1): A 4-day/3-night trip for winner and guest to Nashville, TN, from 10/16/2008-10/19/2008, to attend a Taylor Swift concert. Trip includes round-trip air transportation from the major airport nearest winner’s home, hotel accommodations (double occupancy), a pair of tickets to the concert, round-trip ground transportation to/from airport/hotel in Nashville and $500 spending money for winner (ARV: $4,500). If the Taylor Swift concert is canceled for any reason out of Sponsor’s control, winner will receive tickets to a Sponsor specified Taylor Swift concert in another Sponsor specified city/state. Actual retail value of Grand Prize may vary due to Grand Prize winner’s residence and fares at time of travel. Grand Prize winner and his/her guest must be available to travel between 10/16/2008-10/19/2008 or winner will be disqualified and an alternate winner will be determined. Dates of departure and return are subject to change. Airline carrier's regulations and conditions apply. Trip may not be combined with any other offer and travel may not qualify for frequent flyer miles. Grand Prize winner and his/her guest must possess valid travel documents (i.e., valid government issued photo ID, passport, etc.) in order to travel. Grand Prize winner and his/her travel companion must travel together on the same itinerary. Certain restrictions and blackout dates may apply. Seat selection and timing of trip subject to availability and confirmation of reservations. No refunds or credit for changes are allowed. All other expenses and costs, not expressly listed above, including, but not limited to, taxes, tips, entertainment, transfers, and transportation to airport to and from winner’s home residence are the winner’s sole responsibility.
- Sweepstakes First Prizes (60): A Taylor Swift Prize Pack consisting of an autographed Taylor Swift headshot, a Taylor Swift CD, a Venus® Embrace™ Razor and SatinCare® shave gel. (ARV $30 each). Prizes are nontransferable and no cash substitution is allowed except by the Sponsor, who reserves the right to award a prize of equal or greater value if advertised prize (or portion of prize) is unavailable for any reason. Taxes, as applicable, related to the prize are the sole responsibility of winner. All other expenses and costs not expressly listed above are the winner’s sole responsibility. Limit one First Prize per person.
- Winner Notification: The Administrator will make three (3) attempts to contact the potential Grand Prize Winner via phone within 24 hours from the time winner selection is accomplished. If Administrator is unable to reach the potential Grand Prize Winner via phone within this time frame, he/she will be disqualified and an alternate will be determined. Potential Grand Prize Winner (or his/her parent or legal guardian is potential winner is a minor) will then be required to sign and return an Affidavit of Eligibility, Release of Liability/Publicity Release (except where prohibited by law) within three (3) days of notification attempt or the Grand Prize will be forfeited and alternate winner may be determined. Affidavit package will be mailed via overnight mail with a pre-paid overnight return envelope included or sent via email. Travel companion of Grand Prize Winner (or parent/legal guardian if travel companion is a minor) will be required to execute a Release of Liability/Publicity Release (where legal) prior to departure. If winner is a minor, his/her traveling companion must be his/her parent or legal guardian. If travel companion is a minor, he/she may only travel with his/her parent or legal guardian (i.e., the winner). Return of prize or prize notification as undeliverable may result in disqualification and determination (based on the same judging criteria stated in rule 4) of alternate potential Grand Prize winner at Sponsor’s sole discretion. 1099 tax statements will be filed with the IRS for any winner whose prize value is or exceeds $600.
- General Rules: By participating in the Contest, Entrants agree to be bound by these Official Rules and the decisions of the judges. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any contest materials and the terms and conditions of the Official Rules, the Official Rules shall prevail, govern and control. Participating in the Contest constitutes permission to the Sponsor and its agencies and designees to use participants’ names, biographical information, pictures/portraits, likenesses and/or voices, photos and submitted songs, for purposes of advertising and trade without further compensation or limitation, unless prohibited by law. The Sponsor, its Agencies and Administrators are not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Contest or by any human error which may occur in the processing of the Entries in the Contest or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Contest. The Sponsor reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Contest or Contest Website; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Contest may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest, then the Sponsor reserves the right at its sole discretion to end the entry period and determine the winners from among all eligible Entries received prior to cancellation, based on the same criteria listed above, or cancel the Contest in its entirety.
- Release: Entrant hereby represents and warrants that: (1) all Entry Material submitted (with the exception of the music and lyrics of the song made available at the Contest Website) is wholly original and created and performed by the Entrant and has not been copied in whole or in part from any other work and has not won any previous awards or competitions; (2) the Entry Material is the Entrant’s exclusive work and does not infringe upon or otherwise violate the copyright, trademark, privacy, publicity or other proprietary rights of any third party; (3) the Entrant has the full and exclusive right and authority necessary to submit the Entry Material in the Contest and to grant the rights granted herein without permission from or payment to any third party; and (4) Entrant meets all the eligibility requirements and have not engaged in any of the disqualifying activity set forth herein. By entering the Contest, you (or parent/legal guardian if entrant is a minor) hereby grant the Sponsor, its advertising and promotional agencies, affiliates, subsidiaries, assigns, licensees, and legal representatives the irrevocable, perpetual, worldwide right to use, reproduce, edit, market, store, distribute, have distributed, reproduce, re-arrange, change, add to or delete from, translate, adapt or otherwise revise and/or alter the submitted song, or any broadcast thereof, publicly and privately broadcast, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon, and promote the submitted song, for editorial, commercial, promotional and all other purposes. In addition, you (or parent/legal guardian if you are a minor) hereby assign to the Sponsor all rights, titles, and interests in and to the submitted song and any derivative work using or incorporating the submitted song. You (or parent/legal guardian if you are a minor) waive your moral rights in and to the submitted song in favor of the Sponsor. By participating in the Contest, the Entrant (or parent/legal guardian if entrant is a minor) agrees that Sponsor, its respective parents, subsidiaries, affiliated companies, agents, retailers, advertising and promotion agencies, and all of their respective shareholders, officers, directors, employees and assigns, members, representatives and agents, will have no liability whatsoever for, and will be held harmless by Entrant (or parent/legal guardian if entrant is a minor) for any liability for any bodily injury, loss, cost or damages of any kind to persons, including death and property, damages sustained due in whole or in part, directly or indirectly, from Entry creation, the acceptance, possession, use or misuse of the prize or parts thereof, if applicable or participation in the Contest or participation in any contest or related activity. Sponsor shall not be responsible nor liable for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by the air carriers, hotels or others providing services or accommodations, including loss or damage to baggage. By entering the Contest, you hereby represent and warrant that you have read these Official Rules and are fully familiar with its contents. The Contest and the Official Rules shall be exclusively governed by and construed in accordance with the laws of the state of New York, without regard to conflicts of law provisions. Entrants (or parent/legal guardian if you are a minor) submit to exclusive personal jurisdiction in New York and agree that any dispute shall be brought in the state and federal courts in New York, New York.
- Winners List: For the names of the winners, available after 10/31/2008, send a stamped, self-addressed envelope by 12/1/2008, to: Venus Embrace Your Voice Winners, 100 Marcus Drive, Melville, NY 11747, Department AB. Residents of Vermont may exclude return postage.
